Forum: feature_films Subject: Is 'The Black Cat' (1934) PD?

There's a copy already here in the blip.tv section, but I want to upload a longer, better quality copy. I couldn't find any copyright information about it in the forums. Anyone know?

I couldn't find a renewal in the records for 1962 or the first half of 1961. (Unfortunately, the second half of 1961 isn't available on the web yet.)

I didn't think any Universal films from this period were PD...and the fact that it's part of the blip.tv collection isn't promising. Hope I'm wrong, though. The Black Cat is one of my favorite Lugosi films. Karloff, too. Next to The Old Dark House, it's probably my favorite Universal horror from the '30's.

Thanks for the Lugosi interviews, btw!

Too bad...

But speaking of Universal horror, Lugosi, etc, V-C recently posted that "Some major studios have almost entire years of production...that lapsed into PD due to clerical or financial problems", and mentions Universal's output from 1942.

(http://www.archive.org/iathreads/post-view.php?id=303725)

So, I wonder if that means Ghost of Frankenstein(1942)is PD?

The operative word in what Video-Cellar wrote is 'almost'. I couldn't find anything on the copyright status of Ghost of Frankenstein in the forums.

Better luck with 1947.

Only 75% of the copyrights were renewed, and there are doubts about some of the renewals. For example:

------------- 1976-B.txt --------------------------
0.000
|639293.
The Senator was indiscreet. By
Inter-John, Inc. (c) 8Bar48; L1657.
National Telefila Associates, Inc. (PHH);
60ct75; 8639293.

The IMDB dates this film with 1947, but the renewal claims 1948. In addition, 1975 is shown as the year of renewal, but the listing is in the volume for the second half of 1976.

It may be that this was renewed too late. Perhaps this is one of the clerical errors of which Video-Cellar wrote.

The situation is identical for the following film:

Wow! Thanks for your work. I think that pre-1964 movies had to be renewed in the 28th year after publication, though I couldn't find a link to Video-Cellar or anyone else stating that. I think they also needed a proper copyright notice on the film. So some of these Universal films may be PD. To check The Senator Was Indiscreet, A Double Life, and Hungry Hill one would need a copy of the films. Believe me, IMDb does make mistakes on dates.

If your interested, Video-Cellar also mentioned MGM 1951, RKO [1931], various Hal Roach Studios 1940s, Fox [1946], and pre-1950 UA films as being plum ground for looking for PD movies, and I could make some lists.

here's a link to what Video-Cellar had to say on renewals and copyright notices.

Video-Cellar says A Double Life was properly renewed, so I'd say The Senator Was Indiscreet was too. Hungry Hill is a different matter. If it was released in 1947 as Universal Pictures claims and IMDb shows, but renewed in 1976, then it's renewal is invalid. It's PD.

For "The Senator Was Indiscreet", the IMDB release-date page shows:
USA 26 December 1947 (New York City, New York) (premiere)
The opening credits show:
COPYRIGHT MCMXLVII BY INTER-JOHN, INCORPORATED

By the way, I think that if the date in the copyright notice differs from the actual date of publication, the earlier of the two dates is used to determine when the copyright expires.

If you'll make a list of Fox [1946], I'll have my program do the search. (I don't want to search for films after 1949 because that would have to be done manually at the .gov website.)

It seems to be ok to renew a bit early. See Video-Cellar's post regarding "Dark City" (1950) here.

Out of curiosity, I searched for these in the inventories of some PD vendors:

THE SENATOR WAS INDISCREET (1947)
A DOUBLE LIFE (1947)
HUNGRY HILL (1947)
THE LOST MOMENT (1947)
FRIEDA (1947)
THE UPTURNED GLASS (1947)
SMASH-UP: THE STORY OF A WOMAN (1947)
SMASH-UP (1947)
THE LIFE AND ADVENTURES OF NICHOLAS NICKLEBY (1947)
NICHOLAS NICKLEBY (1947)
GIRL TIME (1947)

Result:

NICHOLAS NICKLEBY (Desert_Island)
---> Not here.
SMASH UP (Buyout, Filmchest)
---> Already here.

Yeah, that's what I figured. If anything had been renewed, it would have been from the Frankenstein franchise.

As for other Universal films...seems that one has to be on IMDB Pro to do a search by year AND production co. (unless I'm missing something). But Wikipedia has this (incomplete) list of Universal films from '42:

Saboteur
The Mummy's Tomb
Arabian Nights
Private Buckaroo (already on IA)
The Mad Doctor of Market Street
The Strange Case of Dr. RX
